Joint bank accounts have become an increasingly popular means by which to transfer assets outside the probate process and/or to allow someone to access funds in order to provide for the care of the other account holder. This fifty-minute webcast will discuss various issues that can arise, resulting in litigation, following the death of one of the joint account holders. The panelists will discuss Banking Law § 675; the difference between true joint accounts and convenience accounts, pay-on-death accounts, and so-called “Totten” trusts; and will provide insight into joint account litigation, including procedural considerations, evidentiary issues, and settlement strategies. The program will also include a discussion of “best practices” to avoid litigation.

 The program panelists have extensive experience litigating contested matters in the Surrogate’s Courts. This program will be valuable for any attorney whose practice may encompass trust and estate litigation.
