Surrogate’s Court proceedings often raise important ethical issues involving actual and potential conflicts of interest. The issues arise due to the number of parties involved and the different capacities in which a party may be involved. 

This presentation discusses the various types of proceedings in which conflicts of interest most often arise in the Surrogate’s Courts, including probate contests and contested accounting proceedings, and reviews relevant Ethics Opinions and the New York State Rules of Professional Conduct governing conflicts of interest involving former clients, current clients, and potential clients.

The program panelists have extensive experience litigating contested matters in the Surrogate’s Courts. This program will be valuable for any attorney whose practice may encompass trust and estate litigation.
