Most trusts and estates practitioners will encounter from time-to-time roadblocks and difficulties in acquiring all necessary information about a decedent’s assets and liabilities in the course of administering an estate. This practical-oriented half-day course will focus on proceedings under Sections 2103 and 2104 (to discover property and obtain information regarding an estate) of the Surrogate’s Court Procedure Act, including how the petitioner, the one who is seeking the information, and the respondent, who is the subject of the inquiry, should handle their respective cases.

The panelists will highlight what issues may give rise in a matter for the lawyer to invoke Section 2103 or 2104, and how to navigate through the process in Surrogate’s Court. In addition, the faculty will suggest variations and alternatives to §2103 proceedings for practitioners to consider and how to do advance planning, prior to the decedent’s death, that can avoid or minimize circumstances leading to difficulties at administration.
