Representing clients in matters related to elder law can be challenging. Let our experienced faculty of elder law practitioners bring you up to date on the current legal developments related to the complex web of elder law practice. This program will focus on a number of key topics related to elder law practice including representing the fiduciary, Guardianship, Community Medicaid, Social Security and an in-depth review of current developments in the area of Medicaid Planning. There will be one hour of the program dedicated to ethical concerns arising in elder law practice such as identifying and handling conflicts of interest, questions about “who is theclient”, when the attorney-client privilege applies, and getting paid. Medicaid planning and Community Medicaid are key topics for this program including financial eligibility criteria, where to apply, planning mechanisms, promissory note/gift updates, spousal budgeting issues, review of recent case law and fair hearing decisions, as well as tips for advocacy.
 
Topics to be covered include:
 
• The latest legal developments in the areas of Guardianship, Community Medicaid, Social Security, and Medicaid Planning.
• Practical tips about representing the fiduciary, traps for the unwary, and advocacy tips for guiding clients through challenging Medicaid planning scenarios.
• Ethical issues involved in elder law practice including conflicts of interest, attorney-client privilege and representing clients with diminished capacity.
