On August 13, 2010, the Governor signed into law recently passed legislation that: 1) allows “no fault” divorce, 2) changes the procedure for setting awards of temporary maintenance while a divorce is pending, 3) creates a presumption that a less monied spouse in a divorce case is entitled to payment of attorneys' fees, and 4) makes changes pertaining to issuance of orders of protection. A fifth piece of legislation, signed by the Governor on July 15, 2010, significantly changes the law regarding child support modification. Our expert panel reviews and analyzes this new legislation and discusses how it will change your practice now and after the effective dates.
Many commentators and lawyers proclaim that relocation is the most troubling area in custody. The program addresses where we currently stand, based on the major 1996 Court of Appeals Tropea relocation case, and how a court will weigh the best interests standard and factors in deciding a relocation request in today's uncertain economy.
Another useful segment of this program will relate how the Rules of Professional Conduct, in effect since spring 2009, specifically impact matrimonial practice.
Finally, the program discusses attorneys' rights and obligations concerning collection of fees from clients, including tips on what you might put in your retainer agreements, the liens you are allowed to seek, and what you can expect in a fee arbitration.
