When dealing with a high profile matter, ethical rules, professional guidelines and media relations mix, creating complex and challenging questions for attorneys. This program presents fact patterns and questions to a prestigious panel of legal, media and public relations professionals to guide attorneys toward projecting the best image for themselves, their clients and the profession.
The first fact pattern addresses a medical malpractice case that the client want publicized in order to effect a change in the law. The panel discusses the balance of gaining attention for a cause against the privilege and confidentiality concerns. The second fact pattern focuses on a criminal client about whom the police release selective information to the press. Among the issues the panel covers is the ethics in balancing client advocacy against media advocacy. The final fact pattern addresses attorney responsibilities to a client with diminished capacity and the practical and ethical issues in commenting on a case while it is being tried.
