Effective October 1, 2014, the Office of Court Administration adopted new rules to prevent the entry of unwarranted default judgments in the more than 100,000 credit card collection cases filed annually. The new rules are designed to ensure a fair legal process in consumer debt litigation, and address numerous abuses such as (i) judgments based upon insufficient or incorrect factual proof or hearsay, (ii) judgments granted after the Statute of Limitations has expired, and (iii) judgments obtained on improper or “sewer service.” This seminar will provide a comprehensive overview of the new rules and the new forms.
