This program will examine in detail the custody process as handled by the key persons involved. With a matrimonial lawyer providing commentary and analysis, you will hear from a judge, an Attorney for the Child, and a mental health expert on their respective roles, responsibilities and methodologies in arriving at what is in the best interests of the child. You will gain insight into the approach of the judge who is deciding whether and when to appoint both the Attorney for the Child and the mental health expert, and if you as the spouse’s attorney can persuade the judge to go in a particular direction on behalf of your litigant-client. The presentations and discussion will help you understand more fully the varied roles, approaches, procedures and goals of the Attorney for the Child and the neutral or party-retained mental health expert. The matrimonial lawyer on the faculty will explore with you the best strategies and possible dangers to your client’s case, depending on how the Attorney for the Child and the expert are handling the situation. The program includes the always useful review of the latest cases, legislation and trends in matrimonial and family law.
