In many cases, effective representation of a client with a disability involves the drafting and administration of Supplemental (Special) Needs Trusts, or SNTs. These trusts are used in many different contexts, from protecting litigation proceeds to managing inherited funds for those without capacity, to providing a supplemental source of money to help enhance the lives of individuals with disabilities residing in the community.

This program will address a comprehensive cross-section of such issues faced by attorneys practicing in this area, including an overview of how SNTs can be used, practical tips on effectively drafting SNTs, and an examination of the types of SNTs to use in different situations – pooled community trusts, SNTs in Article 81 and 17A Proceedings, or using SNTs for personal injury settlements and inheritances. The program will also discuss how the counselor should be advising the trustee of an SNT and the parameters of the trustee’s role.
